TERMS AND CONDITIONS
At Studio Margaret we are 100% committed to providing the best possible service and end product to my clients. I permit a lot of flexibility in the use of my images and simply ask that you notify us of specific desired uses for the photos and of course, provide us with the appropriate credit (Photos by www.studiomargaret.net / Instagram: @renataaphoto & @studiomargaret_mra / Facebook: “Studio Margaret” - @studiomargaretMRA / Margaret Renata Aulejtner) when our images or videos are used.
Booking deposit:
Booking deposit 100$ to be paid as soon as the Client wants to book.
The remaining amount of payment is to be paid on the day of the session, right after the session, and before the final product is delivered.
BY PAYING THE DEPOSIT YOU ARE SECURING THE DATE YOU HAVE REQUESTED AND AGREEING TO THE TERMS

Cancellations/Rescheduling:
Please notify me before 48 hours if you will need to cancel the shoot.
Studio Margaret will charge deposit fee for cancellations not made before 48 hours. Please note, that the entire deposit fee will be also assessed if we arrive at the property to find the shoot is cancelled (including denied access to the property and the home not being ready for photos). Please read Guideline to preparing the Home below.
Reschedules of the session will be accommodated if the new date does not conflict with an existing booking. Photographer must be informed about it as soon as it is possible.There may apply additional fee for rescheduling.
Realtors are responsible to check the weather and house status before scheduling a shoot, therefore, there will be fee of $25 assessed for rescheduling due to bad weather and 100$ for a property not being ready for photos. No exceptions! If it is raining at the time of the shoot, we will continue with the interior shots and wait or return for the exterior shots at another time. If the property is not ready, we will not do any shooting and return another time (in that case if we cannot take pictures when the house is ready and 100$ will be charged for this reschedule). We will not charge additional fee if Studio Margaret is notified about rescheduling in right time and before leaving to the session.

Delivery of the product:
The photographer will take pictures of the whole property as requested: inside - each room and outside area. The photographer can offer drone and night photography for outside area as well.
After the session, the photographer will be culling the best photos (eliminating duplicates, blurs, and blinks) and editing to give them best natural look. The best selected pictures are then edited and delivered to the client.
The number of delivered pictures is not specified, nor limited and all best pictures will be delivered. The amount of pictures is depending on several factors such as: length of the session, size of the property, number of rooms, location, weather, cooperation and others. The quality of photographs are up to 42.5 megapixels.
The gallery is typically ready within 10 working days of the session. An online gallery will be shared through the link to Filemail, WeTransfer or similar. The pictures will be available to download from the gallery for 7 days.​

Videography:
It is also possible to order and book videography that can be taken the same day as the photo session and it must be agreed before with Studio Margaret on the details wanted by the client and the purpose of the video. Studio Margaret can deliver an edited cinematic movie up HD resolution (in slow-motion), or 4K (normal motion) covering and highlighting the main points of the agreed session, showing the most interesting shots taken during the session. The length of the video will depend on size of the property, how much footage was gather during this time, as well as the purpose unless it was specified together with a client. Footage will be edited, color graded and put together into one movie file with music in the background. The final video will be delivered within 25 working days of the session. The client can choose or suggest kind of music they wish to have in the video edit.
Privacy Policy:
Any information we collect in is treated confidentially. We do not share or sell your information to third party companies. If you entered your email, name and phone number this information is only used internally and for future promotional marketing and you will be able unsubscribe at the bottom of any e-mail you receive.
Rights:
Under current copyright laws, ownership of all photos belongs entirely to Studio Margaret.
The Photographer retains all rights to photos taken of properties unless otherwise agreed upon in writing, and only licenses the use of the images to the Listing Agent (“CLIENT”) of the property for marketing purposes while the listing is active (up to two year). All images produced for the client may be used by the client for any and all marketing materials and campaigns associated with the property and for the client’s self promotion until the license expires. The photos may also be used by the client’s parent company for the sole purpose of marketing the specific property photographed. Any usage of the images by a third party, including but not limited to, architects, builders, stagers, designers, sellers or buyers, is strictly prohibited unless approved in writing by the photographer. Client may not sell or reproduce, nor authorize the sale or reproduction of, any portion of the Work without the Studio Margaret written consent.
Relationship of the Parties:
The photographer is an independent contractor, and shall not be deemed to be an employee of the client. No agency, partnership, joint venture, or employee--employer relationship is intended or created by this agreement. Neither party is authorized to act as agent or bind the other party except as expressly stated in this agreement. The photographer and the photos or any other deliverables prepared by the photographer shall not be deemed a work for hire as defined under Copyright Law. All rights granted to client are contractual in nature and are expressly defined by this agreement.
Responsibilities:
It is the clients responsibility to secure access to all areas for photography/videography. The client assumes all responsibilities for obtaining any necessary permissions, clearance permits etc. which may be required for Studio Margaret to photograph/videograph, public or private.
Style and edits:
All creative aspects such as shooting and editing style are at the discretion of the Studio Margaret. The client acknowledges that they are familiar with the Studio Margaret portfolio and is requesting services with knowledge of the Studio Margaret style. Accordingly, client acknowledges that the photos/video shall not be subject to rejection on the basis of taste or aesthetic criteria as they are familiar with the artistic style of Studio Margaret.
The client grants full editorial and production control to Studio Margaret for all aspects of the production and post-production services for the event. In the event a particular segment of the event is either not recorded, partially recorded, or not a part of the edited master tape, it is at the sole discretion of Studio Margaret as the exclusive producer of the events videography and /or photography.
Other info:
Studio Margaret Aulejtner will not be held liable for any production problems beyond our control, e.g. Bad weather, accidents, interference from other people etc.
Studio Margaret reserves the right to terminate this contract at any time for any reasonable cause, e.g. accident or ill health, in this event all monies will be refunded in full.

Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure. In case of technical issues we will come back another time to finish to work if needed.
Upon taking possession of the finished product, the client must inform Studio Margaret of any technical or other problems with their product within 7 days of delivery. After the 7 day period, if no notification has been received, the client will be deemed satisfied with the product. Client understands and agrees that Studio Margaret is not required to maintain copies of the photos from this shoot 60 days after the photos/video have been delivered to Client.
Model Release:
The client hereby grants to the Studio Margaret and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish pictures and/or videos of the client or in which the client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The client hereby releases the Studio Margaret and its legal representatives and assigns from all claims and liability relating to said videos.
